Plenary Session # 1: Tackling Big Data and IoT Challenges and Enforcement Trends in the EU's Digital Single Market
Navigating different global regulatory regimes has become increasingly difficult as products are distributed globally and some become interconnected raising questions of both safety and security. Companies offering digital products and the retailers selling those products often use innovative digital technologies to collect large amounts of data for many different purposes.
Equally important is looking ahead to the different European initiatives in the context of EU’s Digital Single Market Strategy. GDPR directly affects the use of data collected by and about consumer products as consumer complaint data now needs to be manage to meet cross order privacy protections.  The EU’s Internet of Things Policy and the proposed European cybersecurity certification framework for ICT products and services are two more examples that will definitely play a critical role in increasing security and consumer trust. The panelists will tackle all of these issues in an interactive dialogue.
Lastly, we will discuss the enforcement risks within this regulatory framework. Companies will also have to reconsider their liabilities and related compliance strategy both in view of the new safety risks posed by the digital technologies and the scope of mass harm situations which, in a digital world, are likely to cross borders.  The trend toward representative actions in the EU, and the potential implications of the proposed new “Goods Package” will be highlighted by the panelists.

Plenary Session # 2: The Impact of Digitization on Global Alignment of Product Safety Regulations
Regulators and stakeholders often seek better alignment of product safety regulations across jurisdictions to improve health and safety outcomes – preventing or reducing the incidence of traditional product safety hazards, such as mechanical defects and exposure to chemicals and hazardous substances – and/or eliminate unnecessary costs and complexity.  These efforts take on many forms, from mutual recognition of conformity assessment bodies and reliance on international standards to sharing information at the pre-regulatory stage and equivalency arrangements.  As more consumer products become part of the Internet of Things, the free flow of data across borders, data protection and privacy rules, and cybersecurity will become bigger issues for the product safety community, with the potential to improve product safety but also introduce new product safety risks.  As the generation, storage, and use of data and the provision of services become an integral part of everyday products, the alignment of product safety rules internationally becomes more important, and also potentially more challenging.  More regulators may become involved, with different governing legal regimes and different standards being applied.  The rules addressing digital and service issues at the international level (e.g., the World Trade Organization and other free trade agreements) differ from the rules that cover products.  And the major jurisdictions – the European Union, China, and the United States – have very different views on how to regulate the digital economy.  How can the international product safety community best navigate this issue in the coming years?

Plenary Session # 3: Design Products for Diverse Global Populations
While products are typically designed and manufactured to be sold into large diverse communities, the risk profile of those products can vary from person to person within those communities. Best practices in product design dictate that pre-market risk assessments should take into account particular risks that may be presented to more vulnerable members of society, in particular children, the elderly and those with disabilities.  At the same time, there are strong imperatives to ensure that, wherever appropriate, groups in the community are not shut out of access to the benefits and enjoyment of products, and not exposed to additional risks, by reason of their particular differences or vulnerabilities.

This session will explore the concept of inclusivity in product design, and considering ways in which safety can be managed within that concept.  It will include a discussion of “applied anthropometry”, a tool used to guide the design of products by reference to the variations in physical characteristics of people.

By focusing on diversity and inclusion in a more holistic way, the concept of product safety can be taken to new level. This session will consider these issues from a number of perspectives, providing expert insights and perspectives from a range of stakeholders into ways in which the key objectives can be met.

Breakout Session # A1: Social Media and Product Misuse
Social media is no longer optional for brands; it is now a critical part of any brand strategy.  In this engaging and interactive session, three major brands will review current examples of social media posts and memes impacting on product safety. These examples, drawn from an international perspective, show consumers misusing products in a manner that would provide any responsible brand cause for concern.  The panel will provide attendees with a “toolbox” of approaches to address concerning social media at the “right” level given the varying risks. Recognizing that each factual social media situation differs, the toolbox will provide examples of successful (and unsuccessful) attempts at managing and controlling these risks. We also hope attendees will be willing to participate with their own examples.

Breakout Session # A2: Beyond Risk Assessment: Novel Approaches to Using Historic Data to Establish Tolerable Risk of Product Categories in Diverse Communities (Repeating)
When faced with product safety incident data it is difficult to determine what level of risk as acceptable to society. Traditional risk assessment methodologies are valuable, but often fall short as a tool to determine what action is warranted in practice to deal with the risk.   However, historic incident and injury data exists for categories of products, and these data can be presented in a manner that allows comparison of the relative safety of a product within its category. The panel will present approaches to determining the historic level of risk tolerance for various categories of products. It will provide a presentation and comparison of methods that are available to industry, regulators, NGOs and the public when determining the level of risk that is tolerable.  The presentation will include discussion on how risk assessment methodologies, and their application, can be tailored to account for differing risk patterns in a diverse society, including adjustments to ensure the protection of more vulnerable persons. The topic sets up an interesting dynamic for a panel discussion and interaction with the audience.  The panel will provide a European and North American perspective.  Audience participation will include a series of multiple-choice questions concerning audience’s view of product safety risk tolerance and its influences, as well as, significant time for questions.

Breakout Session Panel # A3: Traceability of Products in the EAEU, EU and U.S. (Repeating)
In February 2018, the Eurasian Economic Union (EAEU) signed an Agreement on the common labelling system of goods with control (identification) signs in the Eurasian Economic Union. The aim of the Agreement is to create a unified system whereby goods will be marked with a "means of identification", i.e. a sign or code consisting of a machine-readable sequence of symbols on a bar code, a special Radio Frequency Identification tag or a "material carrier" which is mark that contains anti-counterfeit security elements.  Product identification information will be recorded in a single, central register to be established and maintained by the Eurasian Economic Commission. The Agreement marks a new approach to product labelling and traceability in the region. Russia is leading the members of the Union in introducing their own national implementation of the Agreement and has recently approved a number of key resolutions.

This discussion will examine the application of the Agreement and how it impacts consumers’ rights and the obligations of manufacturers and importers to the region and will also provide a comparison with the EU and US approach to product traceability.

Innovative Products and Their Stakeholders: The New Diversity - Associated Meeting - Conversation # 2
This is a continuation of a discussion regarding value/requests/interest for a Safety Process Standard/Guidance for Developing Safety Criteria for Innovative Products or Innovative Features or Characteristics of Existing Products in the absence if safety standards for those innovative products or characteristics.

Product innovation is neither a product nor an industry.  Inventors, researchers, engineers create unexpected new categories of products and product features without specific ties to, or knowledge of, the consumer product industry, regulations, safety process or safety disciplines.  Innovation has a time component; a product or feature is only innovative when first introduced to the market.  Inventors may lack knowledge of a process for developing safety criteria for their innovative products or product features.

The purpose of the meeting is continued stakeholder inclusion and discussion regarding the value/requests/interest for a safety process standard or guidance that would provide innovators with a process for determining the appropriate safety criteria for their innovative product or product characteristic.

Discussion Meeting Open to All Interested Parties  and will take place during breakfast on Tuesday, November 12, 2018 in a conference room to be announced.

Breakout Session # C4: Chemical Risks in the Contemporary Consumer Environment - Present Challenges and Future Alignment (Non-Repeating)
The divergent world of consumer products exposes us ubiquitously to potentially harmful chemical constituents that were not previously encountered by our ancestors. Chemical risks may be associated directly with the ingredients of products (e.g. potentially hazardous substances in tattoo inks) or indirectly via contaminants (e.g. traces of lead in toys). In addition to the well-known chemical hazards that have led to recommendations or implementations of exposure limits, contemporary research in this field repeatedly makes discoveries that raise fresh safety concerns. Research that focusses on examining new products and new potentially harmful substances is therefore of utmost importance in view of increasing product and consumer safety and provide the authorities with sufficient information for efficient market surveillance. This workshop focusses on the risks, current challenges, and future trends in this critical field of consumer safety.

Breakout Session # C5: Safety of Toys: Steps Toward Alignment (Non-Repeating)
Toy safety affects all of us and allows us to protect children during play activities. At present, there are different working groups dealing with toys safety and different safety standards used around the world. These working groups are looking to address the same safety hazards. This panel will use the toy standards alignment as a case study, exploring successes in aligning standards and steps needed to continue the progress toward alignment. It will use examples from aligning specific toy requirements, while considering the different standards organizations' unique processes and regulatory frameworks (US, EU, Canada).
